1. Who you're contracting with

Fluentprompts is operated by MB Present Simple, a private limited company registered in Lithuania (company code 307281485), with its registered office at Griunvaldo g. 8, Kaunas, Lithuania ("we", "us", "Fluentprompts"). By accessing or using Fluentprompts (the "Service"), you enter into a binding agreement with MB Present Simple on these Terms. If you do not agree, do not use the Service.

2. The Service

Fluentprompts rewrites your prompts to be more effective for specific AI models. Output is generated by third-party AI providers and may vary in quality, accuracy, and tone. The Service is provided for informational and productivity purposes.

3. Accounts and credits

Anonymous visitors receive 1 credit. Signed-in accounts receive 10 credits per day, refilled automatically. Inviting a new user who completes their first rewrite grants +10 credits to both you and the invitee. Free credits have no monetary value, are non-transferable, and may be revoked in cases of abuse.

4. Paid plans, billing, and Merchant of Record

We offer paid options including the Pro subscription (monthly or annual, granting unlimited rewrites for the billing period) and one-time credit packs. Subscription fees are billed in advance and renew automatically each billing period until cancelled. You can cancel a subscription at any time from your account; cancellation takes effect at the end of the current paid period. Credit packs are billed once and the credits are added to your account on payment.

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payments, billing, applicable taxes (VAT/sales tax), invoicing, and refunds are handled by Paddle. By making a purchase you also agree to Paddle's Checkout / Buyer Terms. 5. Acceptable use

You agree not to use the Service to generate content that is unlawful, harmful, harassing, defamatory, infringing, or that violates the policies of the underlying AI providers, or to engage in fraud, spam, security probing, scraping, or interference with the Service. You will not attempt to circumvent credit limits or reverse engineer the Service.

6. Generative AI: your responsibilities

You are responsible for the prompts you submit, how you use the rewritten outputs, and for ensuring you have the rights to any input content. Outputs are generated by AI and may be inaccurate, incomplete, or unsuitable for regulated professional advice (legal, medical, financial). You should review outputs before relying on them. We may filter, refuse, or remove content that violates these Terms or AI provider policies, and we may suspend accounts for repeated infringement or misuse.

7. Intellectual property

You retain ownership of the prompts you submit and the rewrites generated for you. The Fluentprompts name, interface, code, and prompting methodology remain our property. If you believe content on the Service infringes your rights, please contact us and we will review the matter promptly.

8. Third-party AI providers

Rewrites are produced via third-party model providers (e.g. OpenAI, Google). Your submitted prompt text is transmitted to the relevant provider for processing under their terms and privacy policies.

9. No warranty

The Service is provided "as is" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted or error-free.

10. Limitation of liability

To the maximum extent permitted by law, MB Present Simple and its operators shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of your use of the Service. Our aggregate liability for any claim relating to the Service shall not exceed the fees you paid us in the 12 months preceding the event giving rise to the claim.

11. Suspension and termination

We may suspend or terminate your access to the Service for material breach of these Terms, non-payment, suspected fraud or security risk, or repeated or serious policy violations. You may stop using the Service at any time and cancel any active subscription from your account.

12. Governing law

These Terms are governed by the laws of the Republic of Lithuania. Disputes shall be subject to the competent courts of Kaunas, Lithuania, without prejudice to any mandatory consumer protection rights you may have in your country of residence.

13. Changes

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the revised Terms.
